Terms of Service

Please read these terms carefully before using Orbrey. By accessing or using the service, you agree to be bound by these terms.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Orbrey, operated by Orbrey ("we", "us", or "our"). By creating an account or using the service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Orbrey.
2. Description of Service
Orbrey is a household management platform that lets households organise shared calendars, tasks, meal plans, grocery lists, and more. The service is available in two tiers:
- Free — core features for a single household at no cost
- Plus — expanded features, higher limits, and priority support, available as a monthly or annual subscription
We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will endeavour to provide reasonable notice of significant changes.
3. Account Registration & Households
To use Orbrey, you must create an account with a valid email address. You are responsible for:
- Maintaining the confidentiality of your password
- All activity that occurs under your account
- Ensuring the information you provide is accurate and up to date
You may belong to one household at a time. A household can have multiple members, each with their own account. Household admins can invite and remove members. You may leave a household or transfer admin rights from your Settings at any time.
4. Subscriptions & Billing
Billing
Orbrey Plus subscriptions are billed through Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis (monthly or annually, depending on the plan you select). All prices are shown in USD unless stated otherwise.
Auto-Renewal
Subscriptions renew automatically at the end of each billing period. You will receive a receipt via email before each renewal. You can cancel auto-renewal at any time from Settings → Subscription or via the Stripe customer portal.
Cancellation & Refunds
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access to Plus features until then. Refunds are handled separately under our Refund Policy, which sets out the limited circumstances in which refunds are available and confirms your statutory rights under the Australian Consumer Law are not affected.
Price Changes
We may change subscription prices at any time. We will notify you at least 30 days before any price increase takes effect. Continued use of the service after the effective date constitutes acceptance of the new price.
5. Acceptable Use
You agree not to use Orbrey to:
- Violate any applicable law or regulation
- Infringe the intellectual property rights of others
- Upload or transmit malicious software or harmful code
- Attempt to gain unauthorised access to any part of the service or another user's account
- Scrape, crawl, or systematically extract data from the service
- Use the service in any manner that could damage, disable, or impair it
- Harass, abuse, or harm other users
We reserve the right to suspend or terminate accounts that violate these restrictions without prior notice.
6. User Content
You retain ownership of all content you create within Orbrey — your events, tasks, recipes, notes, and other data belong to you. By using the service, you grant Orbrey a limited, non-exclusive licence to store, process, and display your content solely for the purpose of providing the service to you.
You are responsible for ensuring that any content you add to Orbrey does not violate applicable laws or the rights of third parties.
7. Intellectual Property
The Orbrey application, including its design, code, branding, and documentation, is owned by Orbrey and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or other proprietary materials without our prior written consent.
8. Termination
You may delete your account at any time from Settings → Danger Zone. Deletion is immediate and permanent — all your data will be erased within 30 days.
We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law. Where possible, we will notify you before taking action and give you an opportunity to resolve the issue.
9. Disclaimer of Warranties
Orbrey is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.
10. Limitation of Liability
To the fullest extent permitted by law, Orbrey and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, revenue, or goodwill — arising out of or related to your use of or inability to use the service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Orbrey is incorporated, without regard to conflict of law principles. Any disputes arising from these Terms will be resolved in the courts of that jurisdiction.
12. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and update the "Last updated" date at the top of this page. If you continue to use Orbrey after the revised Terms take effect, you accept the updated Terms. If you disagree with the changes, you may cancel your account before the effective date.
